Man Found Responsible for Illegally Entering Residence

Prosecutors Anali Vargas, Stephen Trautmann Jr., and Claude Goldsmith represented the State of Texas today in the trial against Martin Mata. Mata was charged with Criminal Trespass of a Habitation, a Class A Misdemeanor.
On December 27, 2008, Mata’s victims peered through a window to see that the knocking on their front door came from the Defendant, whom they recognized from his having dated their relative approximately fifteen years earlier. They chose to ignore his incessant knocking and made their way to the back of their home in the hopes that he would leave. That is when the victims stated that the Defendant forced a window open and made his way into their home. Once inside the home, Mata was confronted by one of the female victims and a child. At that point, he reportedly became belligerent and argumentative. Both adult female victims and the child victim pleaded with the Defendant to leave and were finally forced to call police. He made his escape before police arrived and was arrested one month later.
A jury panel of six found Mata guilty of Criminal Trespass of a Habitation and imposed the maximum penalty. The Honorable Judge Jesus “Chuy” Garza presided over the trial and sentenced the Defendant to one year in jail and a four thousand dollar fine.
