Court Rules in Favor of the City of Laredo in the CTEH Case

Laredo, Texas – On Thursday, September 23, the City of Laredo received notification from the court regarding the case against Consolidated Towne East Holdings (Plaintiff). This case has been in court for approximately 2 years and it is now dismissed. The plaintiff was developing property along HWY 359 (County area) and had acquired a water line and sewage services from the City. The City argued in order to receive said services from the City, an annexation is required and the expense must be covered by the plaintiff but was refused.
After reviewing all the exhibits and researching the matters alleged by both parties, Judge Monica Z. Notzon from the 111th District Court ruled in favor of the City of Laredo and denied Plaintiff’s motions. Judge Notzon held that annexation was proper and was not considered a taking of property because the annexation bears an essential nexus to a legitimate government interest.
