Laredo, Texas – The City of Laredo is concerned with the decision made today by the 49th District Court Judge, Joe Lopez to reinstate former city employee, Tony H. Moreno, to his position at the Utilities Department. Moreno claimed what was tantamount in the final written order by the Municipal Civil Service Commission. The City of Laredo was not served with a petition and is considering filing a mandamus to challenge the court’s granting of injunction relief without providing the city with sufficient notice. Despite the court’s ruling, there was overwhelming evidence presented at the Municipal Civil Service hearing to support termination.
As per attorneys to the City, these mere clerical oversight alone offer no basis under any applicable civil service rule, other law, or fundamental logic that would justify reinstating Moreno. Despite the ruling, the city does not have an immediate plan to reinstate Moreno without further ruling of this presiding judge or a higher court. Reinstating Moreno will allow him to once again jeopardize the health and welfare of our community.
