David Gerardo Rincon Found Guilty of DWI

(Laredo, Texas)-The Office of the District Attorney reports a guilty verdict for David Gerardo Rincon for driving while intoxicated.

On August 8, 2013, a DPS Trooper was traveling south on Highway US83 where he observed a blue in color Jeep turn too wide on a left turn from Cedar Street onto US83S. The vehicle subsequently failed to drive in a single lane while speeding 60 miles per hour on a 30 mile per hour zone. After the trooper initiated the emergency lights of his patrol vehicle in an attempt to stop the Jeep, the driver then failed to signal a left lane change before making a complete stop at the parking lot of a local business on Meadow Street. The driver was identified as David Gerardo Rincon who was unable to perform standardized field sobriety tests. After the failed tests, he refused to give a breath sample. He was arrested and charged with driving while intoxicated, a class B misdemeanor.

The trial which took place before the County Court at Law II Judge Jesus “Chuy” Garza was heard by a jury who after two hours of deliberation rendered their guilty verdict. During the punishment phase of the trial, the State showed prior convictions ranging from unauthorized use of a vehicle to criminal mischief. After a short deliberation, the jury returned with a sentence of 150 days to serve with a $2,000 fine.

Assistant District Attorneys Eduardo Davila, Rene Benavides and Julia Rubio prosecuted the case for the State.
