The Office of District Attorney Isidro R. Alaniz reports that Elizabeth Astudillo and her father, Vicente Astudillo both turned themselves into the Webb County Jail last night after warrants were issued for their arrest in relation to the death of Nicolas Moreno.
The Astudillos face one count each of Making a Firearm Accessible to a Child, which is a Class A Misdemeanor. According to the information filed by the detective, both were criminally negligent in leaving a firearm in a place to which they knew or should have known a child would gain access; to-wit: leaving the firearm in an unsecured closet within the reach of a child, who gained access to and discharged said firearm, causing the death of Nicolas Moreno on March 9, 2011.
According to District Attorney Isidro R. Alaniz, “The law is very specific, so the warrants we secured for the father and sister of the juvenile involved in this case came after numerous meetings with detectives and an extensive review of all statements and evidence”.
