Auto Pedestrian Fatality Accident

Courtesy Joe Baeza,

On Friday, November 13, 2009, at approximately 6:32pm, a caller reported an auto pedestrian accident by Chicago Street/Juarez Avenue. First arriving officers reported that one of 3 pedestrians was seriously injured and was critical at the scene.  The LPD crash team was activated to investigate the accident.

Preliminary investigation at the scene stated that a white in color small Chevy pickup truck was travelling west bound on the 1400 Chicago Street, and he struck 2 of 3 pedestrians who were crossing the street from south to north on the 4100 Juarez Avenue. Apparently, the driver of the white small pickup truck stopped at the scene after the auto pedestrian accident; as well as other witnesses at the scene.

One of the pedestrians, Emigdnia Rodriguez, age 59, had died at LMC from the injuries sustained when she was hit by the small pickup truck. Mrs. Rodriguez was using a walker to assist her to walk.  The driver of the pickup truck identified as David Fraga, age 55, was given a citation for Failure to Yield Right Of Way to Pedestrians. The male pedestrian, identified as Roberto Rodriguez, age 60, sustained minor injuries and a female child, age 7, escaped injuries from the small pickup truck.

The LPD C.R.A.S.H. team took the driver to the hospital to withdraw a sample of blood and have it analyzed as per procedure to determine that there were no substances in his system that would impair his driving.  Until the results return the case is considered an open investigation.
