Gerardo Venegas Arraignment

(Laredo, Tx)-On Jan 1, 2014 Gerardo Venegas was arrested on twelve violations of the law two of which were DWI and Accident Involving Injuries.

On October 8, 2014 a grand jury issued an indictment charging Venegas with Intoxication Assault, Accident Involving Injury, and Aggravated Assault.

Arraignment date was scheduled for December 4, 2014 at the 341st District Court.  Prior to the case being heard, a waiver of arraignment was filed by defense counsel for Gerardo Venegas.  Co-defendant Armando Venegas, brother of Gerardo Venegas, was charged with Failure to Report a Felony, a class A misdemeanor.  Armando Venegas appeared in court but subsequently his attorney also filed a waiver of arraignment.  Gerardo Venegas did not appear in court.

At the State’s request, the Court issued a warrant for Gerardo Venegas’ arrest on the charges of Intoxication Assault and Aggravated Assault, the two charges pending arrest.  Hours later, on the Court’s own motion, a hearing was scheduled.  Defense counsel for Gerardo Venegas was present.  The court addressed the warrants issued earlier that morning.  Specifically, defense argued to recall the capiases on the Intoxication Assault and the Aggravated Assault offenses.  The State once again urged the Court to keep the capiases in order to comply with proper procedure and to ensure the defendant’s presence at trial for all the charges against him as well as to protect the community as this is Gerardo Venegas’ second alcohol related offense in Laredo.

The court recalled the capiases issued in the morning and did not order the defendant’s arrest on the Intoxication Assault and Aggravated Assault.  Instead, the Court included the Intoxication Assault and Aggravated Assault in the original bond amount for the Accident Involving Injuries charge, which totaled $12,000.  A total of $4,000 per count.
